    1.1 This site is controlled and/or operated by a radio station which is owned by Australian Radio Network Pty Limited [ACN 065 986 987] (“ARN”). Please read these Terms of Use and the Privacy Statement carefully before using this website (“Site”) or any product or service offered by this Site, whether accessed by computer, mobile telephone or other device (“ARN Internet Service”). Certain ARN Internet Services may be governed by additional terms (“Additional Terms”). By using the Site, or an ARN Internet Service, you signify your agreement with these Terms of Use. If you do not agree with any of the below Terms of Use, do not use this Site or ARN Internet Service.

    1.2 ARN and its affiliated and related entities reserve the right, in its sole discretion, to modify, alter or otherwise update these Terms of Use at any time and you agree to be bound by such modifications, alterations or updates.     3.1 By using this Site, or an ARN Internet Service, you represent that you:

    Own the computer, smartphone, tablet or other device (collectively, the “Device”) with which you access the Site or ARN Internet Service or are duly authorised to use the Device; and

    3.2 The owner or the authorised user is responsible for the Device. ARN provides no indemnity for costs associated with the Device including, amongst other things, internet plans and excess data costs, the acquisition or repair of hardware or costs as a result of malware or virus.

    6. IHEARTRADIO

    6.1 ARN is the exclusive authorised licensee of iHeartRadio in Australia. The iHeartRadio site is governed by these Terms of Use. Notwithstanding this, the user acknowledges that by accessing iHeartRadio, they are accessing the iHeartRadio service owned and operated by Clear Channel Communications, Inc (“Clear Channel”).

    6.2 Information provided by a user of the iHeartRadio site is provided direct to Clear Channel in the United States and will be controlled and managed by Clear Channel and subject to United States privacy law. By accessing the iHeartRadio site from Australia or New Zealand, you agree that Clear Channel may provide your information to ARN for use in accordance with the ARN Privacy Policy.

    6.3 Use of the iHeartRadio service will, from time to time, necessitate the transfer of data from ARN to a third party, including Clear Channel as the operator of iHeartRadio. .

    6.4 To the extent, if any, that data is transferred to a third party by ARN, ARN and the user will continue to be bound by these Terms of Use and the ARN Privacy Statement.

    7. ADVERTISERS AND ON-LINE SHOPPING

    7.1 Your relations and dealings with, or participation in promotions of, advertisers and vendors located on or contacted through the Site (but not including purchases made through iHeartRadio functions including the payment for and delivery of goods and services and any other terms, conditions, warranties or representations associated with such dealings are solely between you and the relevant vendor or advertiser. You agree that ARN shall not be responsible or liable, either directly or indirectly, for any loss or damage caused or alleged to be caused by or in relation to any such dealings or as the result of the presence of such advertisers on the Site.
